Romanian court decides dead man can get his driver license back

21 March 2018

After a Romanian court has ruled that a man is dead although he was alive, the magistrates in Iasi, a city in eastern Romania, decided that a driver can still use his driver license, although he has been dead for almost six months.

The man sued the Iasi County Police Inspectorate after having been sanctioned on March 9, 2017 with RON 1,305, and after having his driver license suspended for 90 days for speeding. He challenged the sanction in court, but died before the trial was over.

A first court ruled in favor of the driver in mid-September last year, local Adevarul reported. The man died on October 7. However, the police thought the man should be sanctioned and filed an appeal against the first court’s decision on November 7.

The case was not reviewed by the Iasi Court as the case judge found that the driver was deceased. Even so, the magistrate considered that the sentence of the first court was fair. Thus, the Iasi Court confirmed the first court’s ruling even if, unlike the time of the first ruling, the man who opened the trial was dead.
