A proposal to sanction judges who issue incorrect decisions could negatively impact the independence of the Romanian judiciary system, according to James Hamilton, the president of the International Association of prosecutors.

“I think European judges would be worried about such an idea, because they should not suffer any consequences as long as they think their decision was a good one. What makes a good or a bad decision? At the end of the day, the good decision is taken by the High Court, but this does not mean the arguments of the judges from inferior courts are not solid or good,” said Hamilton, who attended a conference in Romania, organized in partnership with the Venice Commission.

He also believes another proposal, of having a two-tier jurisdiction system within the Constitutional Court, is, again, not such a good idea, because it would slow down the process.
