Company wins against Romanian tax authorities over VAT deduction

A local company, Nidera Romania, has won against Romania’s Tax Authority ANAF in the High Court of Justice.

It thus managed to recover RON 11 million (EUR 2.5 million), which represents the VAT for which ANAF canceled the company’s deduction right.

The High Court decided the tax authorities need to respect the deduction right even if the documents don’t meet all formalities.

“VAT deductibility can’t be conditioned by the existence of other documents, except for the invoice,” according to the High Court, reports local Capital.ro.

The dispute arose after ANAF canceled the company’s deduction right because the notices accompanying the goods and other justificatory documents didn’t include all formal elements.
