RO court rules Hidroelectrica's management was appointed under illegal procedure

The top management of the largest electricity producer in Romania and the largest state-owned company, Hidroelectrica, was recruited under an illegal procedure and, therefore, must be replaced, according to a ruling of the Bucharest Court, quoted by Economica.net.

The ruling is not final. The Court scraps the recruiting and selection procedure for the five members of the company's Directorate, held in 2019 and instructs the company to initiate a new recruitment procedure.

Hidroelectrica expects to win the case at the court of appeal.

"The decision - unprecedented in Romanian jurisprudence, is not enforceable and does not produce immediate effects; the company take all the legal and procedural steps necessary to demonstrate the validity of the selection procedure - carried out in accordance with all the rigors stipulated in GEO 109, and to obtain a favorable decision," the company says in a press release.

The ruling follows a complaint filed by the company's former manager Petronel Chiriac, who previously won another case against Hidroelectrica - which had to pay him the wage owed for the period since he was illegally dismissed.

Hidroelectrica's current Directorate began its four-year term in the summer of 2019, so the five directors' terms expire next summer. The five directors of the company, selected then, with a mandate contract are Bogdan Badea, president, and Marian Bratu, Răzvan Ionuț Pătăliu, Radu Cristian Pop and Cristian Vladoianu.
