Romania’s largest power producer Hidroelectrica has won the lawsuit against the Regulatory Authority for Energy – ANRE and got the court to lift an ANRE decision that banned the company from exporting electricity.

ANRE had fined Hidroelectrica for selling electricity in Hungary between December 2014 and February this year. ANRE motivated its sanction saying that Hidroelectrica had sold energy on a centralized platform in Hungary, managed by Tradition Financial Services, a company active in the brokerage of energy products, although the company was obliged to sell all the energy it produced on the OPCOM platform in Romania.

However, this interpretation of ANRE violated the principle of free movement of goods within the European Union, according to Euro Insol, the legal administrator of insolvent Hidroelectrica.

Hidroelectrica had exported 5 MWh, before it was fined by ANRE and warned about having its supply license removed.

ANRE announced it would challenge the court’s decision.
